Kennesaw Man Charged with Trafficking Marijuana and Other Drugs
Police are accusing a 53-year-old Kennesaw man of possessing pounds of drugs and several firearms. According to police, the suspect was found in possession of 17.5 pounds of alprazolam pills and 1,309.1 grams of marijuana, which were found in multiple baggies along with scales and packaging. Police also found 7.12 pounds of THC cartridges and 8.62 pounds of THC edible gummies which were found in multiple baggies and prepackaged for sale. Police also found 255.6 grams of THC wax packaged in various containers.
In addition to various marijuana products police also found other drugs. These include 208.6 grams of psilocybin mushrooms, 100.3 grams of cocaine, 138.59 grams of fentanyl, 224.9 grams of oxycodone pills, 7.2 grams of MDMA pills, 180.2 grams of Adderall pills, 60.8 grams of Carisoprodol, a muscle relaxer, 8.5 grams of Diazepam pills, and 17.9 grams of LSD with a sheet containing approximately 1,000 doses, according to the warrant.
In addition to the drugs, the suspect was also found in possession of various firearms including an Akkar Shotgun, a New England Firearms Shotgun, a Sierra Six Revolver, a Ruger LCPII, a Sarisilmaz Sar9 Pistol, and an Interarms Revolver, according to the warrant.
The suspect is charged with:
- 9 counts of possession with intent to distribute
- Intent to distribute marijuana (felony – trafficking over 28 grams)
- Fentanyl trafficking and possession
- And possession of a firearm during the commission of a felony
The suspect was arrested on Aug. 12 and currently remains in custody without bond.
Trafficking marijuana under Georgia law
Under Georgia law, marijuana is regulated under the Georgia Controlled Substances Act. Unlike other drugs, marijuana is not considered a scheduled substance. That being said, the penalties for marijuana trafficking are considerable in Georgia. While other states have moved to legalize marijuana for recreational purposes, Georgia is not among them. Those charged under Georgia’s Controlled Substances Act face serious consequences, even for the distribution of marijuana.
O.C.G.A § 16-13-31(c) defines marijuana trafficking as follows:
Except as authorized by this article, any person who sells, manufactures, grows, delivers, brings into this state, or has possession of a quantity of marijuana exceeding ten pounds commits the offense of trafficking in marijuana and, upon conviction thereof, shall be punished as follows:
- (1) If the quantity of marijuana involved is in excess of ten pounds, but less than 2,000 pounds, the person shall be sentenced to a mandatory minimum term of imprisonment of five years and shall pay a fine of $100,000.00;
- (2) If the quantity of marijuana involved is 2,000 pounds or more, but less than 10,000 pounds, the person shall be sentenced to a mandatory minimum term of imprisonment of seven years and shall pay a fine of $250,000.00; and
- (3) If the quantity of marijuana involved is 10,000 pounds or more, the person shall be sentenced to a mandatory minimum term of imprisonment of 15 years and shall pay a fine of $1 million.
In the case mentioned above, the defendant possessed more than 10 pounds of marijuana triggering a mandatory minimum sentence of 5 years and a fine of $100,000.
